In compliance with the Family and Medical Leave Act of 1993, Dixie State University will provide its employees with family and medical leave.
Employees who have been employed for at least one year and for at least 1,250 hours during the preceding twelve month period are eligible for family medical leave.
For employees not eligible for family medical leave, the University will review business considerations and the individual circumstances involved.
All employees who meet the applicable time-of-service requirements may be granted a total of twelve weeks of unpaid family leave including accrued paid sick leave (and vacation leave if the employee elects to use vacation leave) combined (during any twelve month period) for the following reasons.
- The birth of the employee’s child and in order to care for the child.
- The placement of a child with the employee for adoption or foster care.
- To care for a spouse, child or parent who has a serious health condition.
- A serious health condition that renders the employee incapable of performing the functions of his/her job.
The entitlement to leave for the birth or placement of a child for adoption or foster care will expire twelve months from the date of the birth or placement.
Application for Leave
In all cases, an employee requesting leave must complete an “Application for Family or Medical Leave” form and return it to the Human Resources Office.
Benefits Coverage During Leave
During a period of family or medical leave, an employee will be retained on his/her group health plan under the same conditions that applied before the leave commenced.
Return from Leave
An employee must complete a “Notice of Intention to Return from Leave” before s/he can be returned to active status.
Failure to Return from Leave
The failure of an employee to return to work upon the expiration of a family medical leave of absence will subject the employee to immediate termination unless an extension is requested/granted.
